These Terms and Conditions govern your use of the Electric Go Kart Co website (electricgokartco.com) and any quote, inquiry, purchase, or order placed with Electric Go Kart Co ( "we," "us," or "our"). By using the site or placing an order, you agree to these Terms and Conditions.
1. Who May Use This Site
The site is intended for adults, including enthusiasts, collectors, and business buyers. You must be at least 18 years old to place an order. If you are using the site on behalf of a company or organization, you represent that you have authority to bind that organization.
2. Product Positioning and Brand References
Electric Go Kart Co offers electric go karts styled as scaled replicas inspired by iconic automotive designs, including but not limited to the Porsche 911, Nissan Skyline R34, and Ferrari F40. Unless a page specifically says otherwise, Electric Go Kart Co is not affiliated with, sponsored by, or endorsed by any original equipment manufacturer, vehicle marque, or trademark owner. References to silhouettes, colors, and styling themes are descriptive only, and our karts are independent tribute products, not official or licensed goods.
3. Website Content and Availability
We try to keep the site accurate, but website content may include estimated pricing, estimated timing, photography, renderings, or model descriptions that can change. We may update, suspend, or remove content, products, or site features without prior notice.
4. Quotes, Orders, and Order Acceptance
Website content is an invitation to inquire, not a binding offer. A quote or order is not accepted until Electric Go Kart Co confirms it in writing and receives any required deposit or payment. We reserve the right to decline or cancel an order before shipment for reasons such as pricing error, supply issue, suspected fraud, legal risk, or inability to fulfill the requested specification. Because each kart is built to order, please review your configuration carefully before submitting, as changes after your build begins may not be possible.
5. Pricing and Currency
Prices shown on the website are for information and marketing purposes and may change without notice. Unless a written quote or invoice states otherwise, final pricing and payment are issued in US dollars. Taxes, duties, freight upgrades, payment processing fees, and destination-specific costs may be added where applicable.
6. Deposits and Payment
Electric Go Kart Co may require a deposit to reserve production time or confirm a custom order. The remaining balance may be due before shipment or on another schedule stated in your invoice. If payment is late, we may pause production, hold shipment, or cancel the order.
7. Custom Builds and Customer-Supplied Materials
If you upload photos, videos, logos, livery references, or design instructions, you represent that you own them or have the right to let us use them for quoting, design review, production, shipping, marketing approval requests, and post-sale support. You grant Electric Go Kart Co a limited license to use those materials for those purposes.
You may not submit materials that are unlawful, infringing, offensive, deceptive, or unsafe to use in commerce. We may reject requested builds or graphics that create legal or brand-risk issues.
8. Build Timing and Shipping
Production and shipping estimates are not guarantees unless we clearly say otherwise in writing. Shipping, delays, inspections, and freight-related rules are described further in our Shipping Policy.
9. Cancellations, Returns, and Refunds
Refund rights depend on whether the order is custom, whether production has started, and whether the issue is delay, defect, or damage. See our Refund Policy for details.
10. Product Use and Safety
Electric Go Kart Co vehicles are high-performance recreational products. They are not street legal and are not registered or approved for use on public roads, sidewalks, or public spaces. Adult supervision, proper protective equipment (including a helmet and safety harness), safe riding conditions, and age-appropriate operation are the buyer's responsibility. The minimum recommended operator age is 18. Buyers must follow all instructions, warnings, and applicable local laws.
Improper use, racing abuse, operation on public roads, lack of supervision, unsafe terrain, and unauthorized modification may create serious risk of injury or property damage.
11. Limited Warranty
Karts are covered by our written 2-year limited warranty on chassis, motor, and battery. Unless required by law, warranty coverage does not include ordinary wear, cosmetic damage, crash damage, misuse, improper charging, improper maintenance, or unauthorized repairs or modifications.
12. Intellectual Property
The Electric Go Kart Co name, logos, website design, copy, graphics, and original content are owned by Electric Go Kart Co or used with permission. You may not copy, reproduce, or use them commercially without prior written permission. Vehicle names and marks such as Porsche, Ferrari, and Nissan, and model names such as 911, F40, and Skyline, are trademarks of their respective owners, used only to describe the vehicle a kart is styled after.
13. Disclaimer of Warranties
Except for any written warranty expressly provided by Electric Go Kart Co and except where prohibited by law, the website and its content are provided on an "as is" and "as available" basis.
14. Limitation of Liability
To the fullest extent permitted by law, Electric Go Kart Co will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from use of the website or the purchase or use of a product. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. Governing Law and Venue
Unless applicable law requires otherwise, these Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute relating to these Terms or an order will be brought in the state or federal courts serving that jurisdiction, unless Electric Go Kart Co elects another lawful venue.

We may update these Terms from time to time. The effective date at the top of this page tells you when this version was last updated.
